Welcome to Simply Tox, a membership-based neurotoxin clinic located in Salt Lake City, Utah. These Terms & Conditions (the “Terms”) govern all use of our website (the “Site”), clinic services, Memberships, promotions, and related offerings. By accessing or using our Site, purchasing a Membership, or receiving services at our clinic, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you may not use our Site or services.

1. Acceptance of Terms

Your access to and use of our Site or services constitutes your acceptance of these Terms, including any future modifications. You affirm you are at least 18 years of age, have the legal capacity to enter into this agreement, and will provide accurate, up-to-date information at all times.

2. Changes to Terms

We may update or modify these Terms at any time, at our sole discretion. Changes will be effective immediately upon posting to the Site or providing notice to you. Continued use of our services constitutes acceptance of the updated Terms.

3. Use of Site and Services

You may use our Site and services only for lawful purposes and in accordance with these Terms. You are prohibited from misrepresenting your identity, providing false information, or engaging in any activity that disrupts the operation of our Site or services.

4. Medical Services and Information

All content on the Site is for informational purposes only and is not a substitute for professional medical advice, diagnosis, or treatment. Services provided at Simply Tox require an in-person consultation and medical approval by our licensed providers. Not all clients will be eligible for neurotoxin treatment. Eligibility is determined solely by our medical team.

5. Membership Terms

5.1 Nature of Membership

Memberships are a prepaid subscription for a set number of neurotoxin units each month at discounted pricing. Membership fees are billed monthly to the payment method on file.

5.2 Cancellation Policy

Members must provide written notice at least thirty (30) days prior to their next billing date to cancel. Accepted methods of notice include:

If notice is received less than thirty (30) days before the next billing date, one (1) final monthly payment will be processed, and the Membership will remain active until the end of that billing cycle.

All banked neurotoxin units must be used within thirty (30) calendar days after the Membership end date. After this period, unused units will be forfeited, have no cash value, and are non-transferable.

Membership fees are non-refundable under any circumstances, including for unused units or missed appointments.

5.3 Pause Policy

Members in good standing may request to pause their Membership for:

A minimum of one (1) full billing cycle
A maximum of three (3) consecutive billing cycles in any twelve (12) month period

Pause requests must be:

Submitted in writing at least five (5) business days before the next billing date
Confirmed in writing by Simply Tox before becoming effective

No new units will accrue during the pause period. Banked units remain available for use during the pause period but are subject to the thirty (30) day expiration rule if cancellation occurs during the pause.

Membership automatically resumes at the end of the pause period unless the Member provides written cancellation notice at least thirty (30) days before the scheduled reactivation date.

Membership may not be paused if there is an outstanding balance or if a cancellation request is already in process.

5.4 Non-Transferability

Memberships, banked units, and associated benefits are personal to the Member and may not be:

Transferred
Assigned
Gifted to another individual

6. Gift Certificates, Vouchers, and Promotions

No Cash Value: Simply Tox gift certificates have no cash value and cannot be exchanged for cash, credit, or any other form of monetary compensation.
Non-Transferable: Gift certificates are non-transferable and may only be used by the individual whose name is associated with the certificate.
New Clients Only: Gift certificates are for new clients only. Previous clients who return are not eligible.
One-Time Use & Cannot be Combined: Gift certificates are valid for a one-time use only and cannot be applied to multiple transactions or combined with other offers, promotions, or discounts.
Program Enrollment Required: Use of a gift certificate requires the bearer to enroll in a Simply Tox membership or treatment plan. Additional consultations, services, or products outside the specific offer may incur additional fees.
Expiration: Gift certificates must be used within three (3) months from the date of issuance. After this period, the certificate will expire and cannot be redeemed.
Medical Evaluation Required: Use of a gift certificate is contingent upon a medical evaluation by a licensed healthcare provider at Simply Tox to determine the individual’s eligibility for treatment.
No Replacement for Lost Certificates: Simply Tox is not responsible for lost, stolen, or damaged gift certificates. They will not be reissued or replaced.
Subject to End at Any Time: We reserve the right to end, modify, or discontinue these gift certificates at our sole discretion and without prior notice.
Subject to Availability: Participation in programs or services associated with the gift certificate may be subject to availability, and Simply Tox reserves the right to alter or discontinue the offer without prior notice.

7. Limitation of Liability

To the fullest extent permitted by law, Simply Tox, its owners, employees, contractors, and affiliates shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to the use of our Site, services, Memberships, or promotions, even if advised of the possibility of such damages.

8. Dispute Resolution and Governing Law

Any dispute shall be governed by the laws of the State of Utah, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the state and federal courts located in Salt Lake City, Utah.

9. Termination by Simply Tox

We reserve the right to terminate or suspend your access to our Site or services, including active Memberships, immediately and without notice, for:

Violation of these Terms
Fraudulent activity
Non-payment
Behavior deemed unsafe or inappropriate

Botox® is a registered trademark of Allergan, Inc.
Jeuveau® is a registered trademark of Evolus, Inc.
Daxxify™ is a trademark of Revance Therapeutics, Inc.
These are referenced only to identify the products we use; no affiliation or endorsement is implied.

11. SMS Messaging Service

SMS Messaging Service: By providing your phone number, you consent to receive SMS messages from us, including updates, promotions, and other relevant content related to our services.

Message Frequency: You will receive up to 20 messages per month of automated SMS messages, depending on your preferences and the nature of your relationship with us.

Message and Data Rates: Message and data rates may apply based on your mobile carrier’s terms. Please check with your carrier for details.

Privacy Policy: Your information will be handled in accordance with our Privacy Policy, which you can view at simplytox.com/privacy-policy.

Opt-Out Instructions: You may opt out of receiving SMS messages at any time by replying “STOP” to any message. You may also contact us at:

Liability: We are not responsible for any charges, errors, or delays in SMS delivery caused by your mobile carrier or third-party service providers. By opting in, you confirm that you are the owner or authorized user of the phone number provided and that you are at least 18 years old.
